Romania Overhauls Foreign Worker System: What’s Changing in 2026
Romania has introduced one of its most significant labour market reforms in recent years, fundamentally reshaping how employers hire non-EU workers.
Through Government Emergency Ordinance No. 32/2026, the country is moving towards a more controlled, digitised, and compliance-driven system. For employers relying on overseas talent, this is not a minor update. It is a structural reset.

What Has Changed in 2026?
The 2026 reform replaces a fragmented and often complex process with a centralised framework designed to improve oversight, reduce abuse, and align migration with economic needs.
At its core, the new system introduces stricter controls while simultaneously aiming to streamline administrative procedures.
1. A Fully Digital Immigration & Work Permit System
All applications and permits are now processed through one centralized digital platform.
2. New Employer Registration & Authorisation Requirements
Employers must meet stricter criteria and obtain approval before hiring foreign workers.
3. Introduction of the “Deficit Occupations List”
Foreign workers can generally only be hired for jobs on an official shortage list.
4. Stricter Rules for Recruitment Agencies
Agencies must be authorized, meet financial requirements, and cannot charge workers unfair fees.
5. Increased Compliance & Employer Responsibilities
Employers must actively monitor, report, and ensure proper working conditions for foreign workers.
6. Tougher Penalties for Non-Compliance
Violations can result in high fines and possible suspension of hiring rights.
7. Work Permit Quotas and Labour Market Reality
A 90,000 permit cap for 2026 limits hiring despite ongoing labor shortages.
Romania’s 2026 overhaul marks a decisive move towards a more regulated, transparent, and digitally managed foreign worker system.
For employers, success will depend on preparation, compliance, and a clear hiring strategy aligned with the new framework.
