B1 And B2 Visa Holder Can Apply for Jobs And Attend Interviews in the US

Great news for travellers with B-1 or B-2 visas.

US Citizenship and Immigration Services (USCIS) has announced that the doors to career opportunities in the United States are open to those travelling on a B-1 or B-2 visa. 

Visitors to the US with  B-1 or B-2 now apply for new jobs and even appear in interviews but must first ensure their visa status has been updated before assuming any new roles.

“Many people have asked if they can look for a new job while in B-1 or B-2 status. The answer is, yes. Searching for employment and interviewing for a position are permissible B-1 or B-2 activities,”

B visas are all-encompassing for nearly all forms of temporary travel, except for student travel, which is specifically covered by F-1 visas.

Non-Immigrant Workers

USCIS stated that when non-immigrant workers are laid off, they may not be aware of their options and may, in some instances, wrongly assume that they have no option but to leave the country within 60 days.

When a non-immigrant worker’s employment is voluntarily or involuntarily terminated, they typically may take one of the following actions, if eligible, to remain in a period of authorised stay in the US:

  • File an application for a change of nonimmigrant status;
  • File an application for adjustment of status;
  • File an application for a “compelling circumstances” employment authorisation document; or
  • Be the beneficiary of a non-frivolous petition to change employer.

if any of the outlined actions occur during the 60-day grace period, the nonimmigrant's stay in the US can stretch beyond the 60-day limit, regardless of their previous nonimmigrant status, the USCIS has advised.

However, if the worker fails to take any measures within the 60-day window, they will be required to depart the US.
